These Affiliate Program Terms (Affiliate Terms) govern participation in the Crosslist Affiliate Program (Program). They apply only to affiliates. If there is a conflict between these Affiliate Terms and the Crosslist Terms of Service, these Affiliate Terms control for Program participation.

Program overview

By applying to or participating in the Program, you agree to these Affiliate Terms. Crosslist BV (we, us, our) may accept or reject any application at its sole discretion.

Eligibility and account registration

To participate, you must:

  • Be at least 18 years old.

  • Provide your legal full name, a valid email address, and any information requested during sign-up.

  • Use one account per legal entity (individual or company).

  • Keep your login credentials secure.

You may not participate in the Program for illegal, unauthorized, deceptive, or fraudulent activities. You must comply with all applicable laws, including advertising, consumer protection, copyright, trademark, and data protection laws.

Affiliate links, tracking and attribution

Affiliate link

Once accepted, you will receive a unique affiliate link. You may change how the link is displayed for marketing purposes, but you must not alter its tracking functionality.

Tracking and attribution

Tracking and attribution are determined by our tracking partner, FirstPromoter, and our configuration of that system. Our records and FirstPromoter’s logs are the final authority for referral attribution and commission calculations.

Tracking may fail due to factors outside our control, including cookies being disabled, private browsing, ad blockers, link alteration, browser restrictions, or network settings. If a referral is not tracked, we may be unable to attribute it.

Purchase window

A referred customer must complete a purchase within 60 days of clicking your affiliate link to qualify, as determined by the tracking system.

Promotion rules

You may promote Crosslist using your affiliate link and truthful, clear marketing content.

You must not:

  • Make false, misleading, or deceptive claims about Crosslist pricing, features, results, integrations, or marketplace relationships.

  • Impersonate Crosslist, claim to be an employee, or suggest an official partnership beyond being an affiliate.

  • Use spam, unsolicited messaging, or any marketing method that violates laws or platform rules.

  • Use deceptive tactics such as fake reviews, fake scarcity, or misleading calls to action.

If we determine, in our sole discretion, that you have violated these promotion rules, we may immediately suspend or terminate your participation in the Program and withhold or forfeit unpaid commissions in accordance with these Affiliate Terms.

No paid advertising

Paid advertising is not allowed without our prior written approval. This includes search ads, display ads, paid social ads, boosted posts, and any paid traffic acquisition.

Trademarks, brand bidding and confusing assets

You may not bid on, purchase, or target keywords, search terms, domains, or handles that include Crosslist, Cross List, or confusingly similar variants or misspellings.

You may not register or use domains, subdomains, or social profiles that could reasonably confuse users about affiliation with Crosslist.

Content marketing and social platforms

You may promote Crosslist through content marketing and organic promotion on your own channels, including your website or blog, email newsletters (where permitted by law), YouTube, TikTok, Instagram, Facebook, X, Reddit, and other social or community platforms.

Your promotions must be accurate, not misleading, and must not imply that you are Crosslist or that you can provide official support, special terms, or guarantees on our behalf. You must also follow the rules and policies of the platform you use.

Incentives

Affiliates may share their affiliate link with customers. The affiliate link may automatically provide a customer discount as described in the Coupon codes and discounts section.

You may not offer any additional incentives beyond what Crosslist provides through the Program, such as cash, rebates, gifts, bonuses, or extra discounts, unless Crosslist approves it in writing.

Crosslist may, in its sole discretion, provide certain affiliates with a coupon code or other promotional benefit. Any such benefit is optional, may be changed or revoked at any time, and is not available to all affiliates.

Comparisons

You may not publish false or misleading comparisons. Opinions are allowed, but factual claims must be accurate.

Self-referrals

Self-referrals are not permitted. You may not use your affiliate link or benefits to purchase Crosslist for yourself or for an entity you control, and you may not attempt to route your own purchases through your affiliate link.

Coupon codes and discounts

Coupon codes are not generally available in the Program. Affiliates promote Crosslist using their affiliate link.

For select top-performing affiliates, Crosslist may, in its sole discretion, provide a coupon code upon request. Any coupon code provided:

  • May be changed or revoked at any time

  • Must not be shared or published on coupon websites, deal aggregators, or similar directories

  • Must not be distributed in a way that violates these Affiliate Terms or any platform rules

If you share your affiliate link with a customer, the customer may automatically receive a discount (currently 30 percent). We may change or discontinue this automatic discount at any time.

Commission, duration and eligibility

Commission rate and duration

The commission rate is 30 percent of net subscription revenue actually received by Crosslist from each referred customer for a duration of 12 months from the customer’s first successful payment.

Net subscription revenue excludes refunds, chargebacks, reversals, credits, promotional discounts, taxes, and payment processing fees, as well as fraudulent or unpaid transactions.

Upgrades and downgrades

If a referred customer upgrades, your commission may increase accordingly. If they downgrade, your commission will be based on the lower-tier plan.

Fraud and abuse

We may disqualify commissions where we reasonably suspect fraud or abuse, including fake sign-ups, bot traffic, suspicious patterns, repeated sign-ups by the same user, or violations of these Affiliate Terms.

Payments and payout timing

Affiliate commissions are calculated monthly. If your available commission balance for a given month meets the minimum payout threshold of $30, we typically initiate payouts in the following month after review and approval in our tracking partner, FirstPromoter.

Payouts are generally processed on a monthly Net-20 basis, meaning commissions earned in one month are typically paid around the 20th of the next month. Actual receipt dates may vary due to reviews, fraud checks, refund or chargeback activity, verification requirements, and processing times of our payout partner, Dots.

We may delay or withhold payouts where reasonably necessary to investigate suspected fraud, policy violations, tracking issues, or disputes, or where required by law.

Refunds, chargebacks, withholding and clawbacks

Transactions that are refunded, charged back, reversed, unpaid, or found to be fraudulent do not qualify for commissions.

If commissions have already been credited or paid and later become invalid due to refunds, chargebacks, reversals, fraud, policy violations, or tracking errors, we may withhold payouts, offset future commissions, and require repayment where permitted by law.

Customer relationship

Customers referred through the Program are customers of Crosslist. Our pricing, customer service policies, and operational procedures apply to those customers.

You may not negotiate separate terms on behalf of customers, claim to offer official support, or represent that you can provide special pricing beyond what Crosslist provides through approved affiliate benefits.

Term, termination and effect of termination

The Program begins upon our acceptance of your application and continues until terminated by either party.

We may suspend or terminate your participation at any time, with or without cause, including for violations of these Affiliate Terms.

Upon termination, you must promptly stop promoting Crosslist using affiliate links and stop using Crosslist branding materials where reasonably possible.

We may forfeit unpaid commissions that were earned through prohibited marketing methods, fraud, deception, or other violations of these Affiliate Terms, or that are subject to withholding or clawback.

We may end the Program at any time. Upon Program termination, we will pay legitimate outstanding earnings subject to these Affiliate Terms.

Relationship of the parties

You and Crosslist are independent contractors. Nothing in these Affiliate Terms creates a partnership, joint venture, agency, franchise, sales representative, or employment relationship.

You have no authority to make or accept offers or representations on behalf of Crosslist.

Limitation of liability

To the maximum extent permitted by law, Crosslist and its officers, directors, employees, shareholders, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, or business interruption, arising out of or related to the Program.

Force majeure

We are not liable for delays or failures caused by events beyond our reasonable control, including outages of telecommunications networks, failures of tracking or payout providers, or governmental actions.

Governing law and jurisdiction

These Affiliate Terms are governed by the laws of Belgium. You agree that the courts of Kortrijk, Belgium have exclusive jurisdiction over disputes arising out of or relating to the Program, except where mandatory law provides otherwise.

Tracking and attribution are determined by our tracking partner, FirstPromoter, and our configuration of that system. Our records and FirstPromoter’s logs are the final authority for referral attribution and commission calculations.

Tracking may fail due to factors outside our control, including cookies being disabled, private browsing, ad blockers, link alteration, browser restrictions, or network settings. If a referral is not tracked, we may be unable to attribute it.

Purchase window

A referred customer must complete a purchase within 60 days of clicking your affiliate link to qualify, as determined by the tracking system.

Promotion rules

You may promote Crosslist using your affiliate link and truthful, clear marketing content.

You must not:

  • Make false, misleading, or deceptive claims about Crosslist pricing, features, results, integrations, or marketplace relationships.

  • Impersonate Crosslist, claim to be an employee, or suggest an official partnership beyond being an affiliate.

  • Use spam, unsolicited messaging, or any marketing method that violates laws or platform rules.

  • Use deceptive tactics such as fake reviews, fake scarcity, or misleading calls to action.

If we determine, in our sole discretion, that you have violated these promotion rules, we may immediately suspend or terminate your participation in the Program and withhold or forfeit unpaid commissions in accordance with these Affiliate Terms.

No paid advertising

Paid advertising is not allowed without our prior written approval. This includes search ads, display ads, paid social ads, boosted posts, and any paid traffic acquisition.

Trademarks, brand bidding and confusing assets

You may not bid on, purchase, or target keywords, search terms, domains, or handles that include Crosslist, Cross List, or confusingly similar variants or misspellings.

You may not register or use domains, subdomains, or social profiles that could reasonably confuse users about affiliation with Crosslist.

Content marketing and social platforms

You may promote Crosslist through content marketing and organic promotion on your own channels, including your website or blog, email newsletters (where permitted by law), YouTube, TikTok, Instagram, Facebook, X, Reddit, and other social or community platforms.

Your promotions must be accurate, not misleading, and must not imply that you are Crosslist or that you can provide official support, special terms, or guarantees on our behalf. You must also follow the rules and policies of the platform you use.

Incentives

Affiliates may share their affiliate link with customers. The affiliate link may automatically provide a customer discount as described in the Coupon codes and discounts section.

You may not offer any additional incentives beyond what Crosslist provides through the Program, such as cash, rebates, gifts, bonuses, or extra discounts, unless Crosslist approves it in writing.

Crosslist may, in its sole discretion, provide certain affiliates with a coupon code or other promotional benefit. Any such benefit is optional, may be changed or revoked at any time, and is not available to all affiliates.

Comparisons

You may not publish false or misleading comparisons. Opinions are allowed, but factual claims must be accurate.

Self-referrals

Self-referrals are not permitted. You may not use your affiliate link or benefits to purchase Crosslist for yourself or for an entity you control, and you may not attempt to route your own purchases through your affiliate link.

Coupon codes and discounts

Coupon codes are not generally available in the Program. Affiliates promote Crosslist using their affiliate link.

For select top-performing affiliates, Crosslist may, in its sole discretion, provide a coupon code upon request. Any coupon code provided:

  • May be changed or revoked at any time

  • Must not be shared or published on coupon websites, deal aggregators, or similar directories

  • Must not be distributed in a way that violates these Affiliate Terms or any platform rules

If you share your affiliate link with a customer, the customer may automatically receive a discount (currently 30 percent). We may change or discontinue this automatic discount at any time.

Commission, duration and eligibility

Commission rate and duration

The commission rate is 30 percent of net subscription revenue actually received by Crosslist from each referred customer for a duration of 12 months from the customer’s first successful payment.

Net subscription revenue excludes refunds, chargebacks, reversals, credits, promotional discounts, taxes, and payment processing fees, as well as fraudulent or unpaid transactions.

Upgrades and downgrades

If a referred customer upgrades, your commission may increase accordingly. If they downgrade, your commission will be based on the lower-tier plan.

Fraud and abuse

We may disqualify commissions where we reasonably suspect fraud or abuse, including fake sign-ups, bot traffic, suspicious patterns, repeated sign-ups by the same user, or violations of these Affiliate Terms.

Payments and payout timing

Affiliate commissions are calculated monthly. If your available commission balance for a given month meets the minimum payout threshold of $30, we typically initiate payouts in the following month after review and approval in our tracking partner, FirstPromoter.

Payouts are generally processed on a monthly Net-20 basis, meaning commissions earned in one month are typically paid around the 20th of the next month. Actual receipt dates may vary due to reviews, fraud checks, refund or chargeback activity, verification requirements, and processing times of our payout partner, Dots.

We may delay or withhold payouts where reasonably necessary to investigate suspected fraud, policy violations, tracking issues, or disputes, or where required by law.

Refunds, chargebacks, withholding and clawbacks

Transactions that are refunded, charged back, reversed, unpaid, or found to be fraudulent do not qualify for commissions.

If commissions have already been credited or paid and later become invalid due to refunds, chargebacks, reversals, fraud, policy violations, or tracking errors, we may withhold payouts, offset future commissions, and require repayment where permitted by law.

Customer relationship

Customers referred through the Program are customers of Crosslist. Our pricing, customer service policies, and operational procedures apply to those customers.

You may not negotiate separate terms on behalf of customers, claim to offer official support, or represent that you can provide special pricing beyond what Crosslist provides through approved affiliate benefits.

Term, termination and effect of termination

The Program begins upon our acceptance of your application and continues until terminated by either party.

We may suspend or terminate your participation at any time, with or without cause, including for violations of these Affiliate Terms.

Upon termination, you must promptly stop promoting Crosslist using affiliate links and stop using Crosslist branding materials where reasonably possible.

We may forfeit unpaid commissions that were earned through prohibited marketing methods, fraud, deception, or other violations of these Affiliate Terms, or that are subject to withholding or clawback.

We may end the Program at any time. Upon Program termination, we will pay legitimate outstanding earnings subject to these Affiliate Terms.

Relationship of the parties

You and Crosslist are independent contractors. Nothing in these Affiliate Terms creates a partnership, joint venture, agency, franchise, sales representative, or employment relationship.

You have no authority to make or accept offers or representations on behalf of Crosslist.

Limitation of liability

To the maximum extent permitted by law, Crosslist and its officers, directors, employees, shareholders, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, or business interruption, arising out of or related to the Program.

Force majeure

We are not liable for delays or failures caused by events beyond our reasonable control, including outages of telecommunications networks, failures of tracking or payout providers, or governmental actions.

Governing law and jurisdiction

These Affiliate Terms are governed by the laws of Belgium. You agree that the courts of Kortrijk, Belgium have exclusive jurisdiction over disputes arising out of or relating to the Program, except where mandatory law provides otherwise.
